This Privacy Notice describes how Avondale collects and uses Personal Data about you through the use of our Website (defined below), and through email, telephone, and other electronic communications between you and Avondale.

This policy applies to information we collect:

  • on our Website;
  • at one of our Avondale dealerships, if you elect to test drive, purchase or lease a vehicle or to receive service on your vehicle;
  • through our Services; and
  • by email, telephone and other electronic messages between you and us.

It does not apply to information collected by:

  • Avondale through any other means, including on any other website operated by Avondale or any third-party;
  • any third party, including through any application or content (including advertising) that may link to the Website.

This Privacy Notice may change from time to time (see Changes to Our Privacy Notice). 2. Children Under the Age of 13

Our Website and Services are not intended for children under the age of 13 and children under the age of 13 are not permitted to directly use our Website or Services. We do not knowingly collect Personal Data from children under 13. If you are under 13, do not use or provide any information on our Website, on or through any of its features, or use our Services, including, but not limited to, providing your name, address, telephone number, or email address. If we learn we have collected or received Personal Data from a child under 13, we will delete that information. If you believe we might have any information from a child under 13, please contact us.

3. Information We Collect About You and How We Collect It

We collect different types of information about you, including information that may directly identify you, information that is about you but individually does not personally identify you, and information that we combine with our other users. This includes information that we collect directly from you or through automated collection technologies.

Generally

We collect several types of information from and about users of our Website:

  • by which you may be personally identified, such as first and/or last name, postal address, e-mail address, telephone number, date of birth, social security number, driver's license, and financial information (request for credit or financing approval) ("Personal Data");

  • from our affiliates and third parties, for example, our business partners that help determine eligibility and process requests for the purchase or lease of a vehicle.

Information You Provide to Us

The information we collect are:

  • information that you provide by filling in forms on our Website or to our Avondale dealership partners. This includes information provided when requesting a quote or vehicle service, purchasing a vehicle, or requesting further information from us;
  • information that you provide over the phone with our sales experience manager or in person when requesting a quote or purchasing or leasing a vehicle through one of our Avondale dealerships;
  • records and copies of your correspondence (including telephone and email addresses and any transcript of a call), if you contact us;
  • your responses to surveys that we might ask you to complete for research purposes; and
  • when you report a problem with our Website.

The Personal Data we collect from you may be required to enter into a contract with our Avondale dealerships, for our Avondale dealerships to perform under the contract, and to provide you with our products and Services. If you refuse to provide such Personal Data or withdraw your consent to our processing of Personal Data, then in some cases we may not be able to enter into the contract or fulfill our obligations to you under it.

You also may provide information to be published or displayed (hereinafter, "Posted") on public areas of the Website (collectively, "User Contributions"). Your User Contributions are entirely voluntary and are Posted on and transmitted to others at your own risk.

Information We Collect Through Automatic Data Collection Technologies

As you navigate through and interact with our Website, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns:

We do not share, sell, or otherwise disclose your Personal Data for purposes other than those outlined in this Privacy Notice. We disclose your Personal Data to a few third parties, including:

  • our third-party service providers that we use to support our business;

  • to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Avondale assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Avondale about our customers are among the assets transferred;
  • to fulfill the purpose for which you provide it. For example, we may disclose your Personal Data to an Avondale dealership to finalize your purchase;
  • for any other purpose disclosed by us when you provide the information; and

We do not control the collection and use of your information collected by third parties described above in Disclosure of Your Information. When possible, these organizations are under contractual obligations to use this data only for providing the services to us and to maintain this information strictly confidential. These third parties may, however, aggregate the information they collect with information from their other customers for their own purposes.

In addition, we strive to provide you with choices regarding the Personal Data you provide to us. We have created mechanisms to provide you with control over your Personal Data:

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some cookies, or to alert you when cookies are being sent. However, if you choose to refuse cookies you may be unable to access certain parts of our Website.
  • Promotional Offers from Avondale. We may also use your information to contact you about our products and services that may be of interest to you. If we have sent you a promotional email, you unsubscribe by clicking unsubscribe at the bottom of these communications. This opt out does not apply to information provided to Avondale as a result of a request for a quote to purchase or lease a vehicle or a service repair.

We do not control third parties' collection or use of your information to serve interest-based advertising. You may access and update your Personal Data at any time by contacting us.

You may notify us through the Contact Information below of any changes or errors in any Personal Data we have about you to ensure that it is complete, accurate, and as current as possible. We may not be able to accommodate your request if we believe it would violate any law or legal requirement or cause the information to be incorrect.

8. Do Not Track Signals

We may use automated data collection technologies to track you across websites. We currently do not honor do-not-track signals that may be sent by some browsers.

We also may use automated data collection technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking). Some web browsers permit you to broadcast a signal to websites and online services indicating a preference that they "do not track" your online activities. Because there is no standard for these signals at this time, we currently do not honor such signals and we do not modify what information we collect or how we use that information based upon whether such a signal is broadcast or received by us.

9. Data Security

Unfortunately, the transmission of information via the Internet is not completely secure. Although we take security measures to protect your Personal Data, including providing training and communications programs designed to educate employees about the meaning and requirements of our data security and confidentiality measures, we cannot guarantee the security of your Personal Data transmitted to our Website or by telephone to our representatives. Any transmission of Personal Data is at your own risk. We are not responsible for circumvention of any security measures contained on the Website.

We may change this Privacy Notice at any time. It is our policy to post any changes we make to our Privacy Notice on this page with a notice that the Privacy Notice has been updated on the Website's home page. If we make material changes to how we treat our users' Personal Data, we will notify you through a notice on the Website's home page.
